Purpose<\/h6>\n<p>The purpose of these terms of use is to outline rights and responsibilities of Lobin Co. (the \u201cCompany\u201d) and the users in association with the online internet services (the \u201cServices\u201d) provided by the \u201cCompany\u201d at the homepage (lobin.co, websites under the sub-domains and applications provided at the websites, collectively referred as the \u201cHomepage\u201d hereinafter).<\/p>\n<h6>Article 2. Definitions<\/h6>\n<p>\u2460 A \u201cUser\u201d means an individual or a corporate accessing the \u201cHomepage\u201d to use the \u201cServices\u201d provided at the \u201cHomepage\u201d under these terms of use, including \u201cMembers\u201d and \u201cNon-members\u201d.<\/p>\n<p>\u2461 A \u201cMember\u201d means an individual or a corporate who has signed up for the membership to continuously use the \u201cServices\u201d provided at the \u201cHomepage\u201d, under these terms of use.<\/p>\n<p>\u2462 A \u201cNon-member\u201d means an individual or a corporate who uses the \u201cServices\u201d provided to the limited degree at the \u201cHomepage\u201d, without signing up for the membership.<\/p>\n<h6>Article 3. Clarification and Revision of the Terms of Use<\/h6>\n<p>\u2460 The \u201cCompany\u201d shall post these terms of use, the privacy policy, the name of the business and its representative, the address (including the address of the place where customer supports can be requested and\/or provided), the telephone number, the email address, the fax number, the business registration number, and the online sales declaration number on the front page of the \u201cHomepage\u201d in order for \u201cUsers\u201d to easily identify those. In this case, the contents of these terms of use and the privacy policy can be displayed via the connection screen.<\/p>\n<p>\u2461 The \u201cCompany\u201d may revise or amend these Terms of Use to the extent permitted under the applicable laws including the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-Door Sales, and the Framework Act on Consumers.<\/p>\n<p>\u2462 When the \u201cCompany\u201d revises or amends these terms of use, the \u201cHomepage\u201d shall provide the date of effect and the reasons for such revision, along with the current version of the terms, on the front page of the \u201cHomepage\u201d at least seven(7) days in advance. However, when the change of these terms of use is expected to have material impact on the \u201cUsers\u201d\u2019 rights and responsibilities, notification about such change shall be provided at least thirty(30) days in advance. In this case, the \u201cHomepage\u201d shall provide both current and new versions of the Terms of Use to make sure that the \u201cUsers\u201d can easily understand the difference.<\/p>\n<p>\u2463 Any change in these terms of use shall be applied only to the \u201cUsers\u201d who accept the new terms on or after the date of effect. The new terms shall apply only if the existing \u201cUsers\u201d express their intention to accept the new terms within the notification period set by Item 3 above.<\/p>\n<p>\u2464 Any matters not prescribed in these terms of use shall be governed by the relevant laws and regulations as well as the policies and guidelines for individual services (hereinafter referred to as the \u201cDetailed Guidelines\u201d). In addition, if these terms and conditions conflict with the contents of the \u201cDetailed Guidelines\u201d, the \u201cDetailed Guidelines\u201d apply.<\/p>\n<h6>Article 4. Scope of the Services Provided<\/h6>\n<p>\u2460 The \u201cServices\u201d provided at the \u201cHomepage\u201d by the \u201cCompany\u201d are composed of the following items:<\/p>\n<ol>\n \t<li>Lodging Industry Data Services: \u201cServices\u201d provided through Lobin Dashboard (dashboard.lobin.co and its subsidiary website), including search and view of supply, demand, operating performance, financial position and asset value data, analysis of lodging market competitive environment, positioning check of lodging properties, and planning of lodging businesses<\/li>\n \t<li>Lodging Business Workout Services: \u201cServices\u201d provided through Lobin Rebounder (rebounder.lobin.co and its subsidiary website), including search and view lodging properties and experts by field, registration of a related person for a lodging property or an experts for a field, matching experts to resolve issues of lodging businesses, and launching and managing projects for lodging business workout<\/li>\n \t<li>Other \u201cServices\u201d provided online or offline in association with the item 1 through 2 above<\/li>\n<\/ol>\n<p>\u2461 The \u201cServices\u201d referred in the item 1 through 3 shall be provided only to the \u201cMembers\u201d, and the \u201cMembers\u201d may use each \u201cService\u201d for free or for a fee.<\/p>\n<p>\u2462 The terms and conditions of use agreement, payment methods, withdrawal of purchase and refund policies related to the \u201cServices\u201d provided for a fee shall be as prescribed by the Payment Terms.<\/p>\n<p>\u2463 Notwithstanding the paragraph 2 above, the \u201cCompany\u201d may provide part of the \u201cServices\u201d to \u201cMembers\u201d or \u201cNon-Members\u201d free of charge, only if it is deemed necessary for the public benefits or the sign-up decisions by the \u201cUsers\u201d.<\/p>\n<h6>Article 5. Interruption of the Services<\/h6>\n<p>\u2460 The \u201cCompany\u201d may suspend the \u201cServices\u201d in the event of the maintenance, repair, exchange, breakdown, or interruption of information communication facilities, such as computers, until the circumstance is resolved.<\/p>\n<p>\u2461 The \u201cCompany\u201d may redeem the \u201cMembers\u201d, who have already paid for the relevant \u201cServices\u201d, for damages caused by such interruption of the \u201cServices\u201d. However, this shall be applicable only if such interruption is caused by gross negligence of the \u201cCompany\u201d.<\/p>\n<p>\u2462 If the \u201cCompany\u201d is no longer able to provide the \u201cServices\u201d due to change of business or merger with different businesses, the \u201cCompany\u201d shall notify the \u201cMembers\u201d of discontinuation of the \u201cServices\u201d in accordance with Article 6 hereof. In such cases, mileage or reserves of the \u201cMembers\u201d may be redeemed in cash or in kind corresponding to the currency used on the \u201cHomepage\u201d.<\/p>\n<h6>Article 6. Notification to the Members<\/h6>\n<p>\u2460 The \u201cCompany\u201d may give notifications to the \u201cMember\u201d through the specified email address provided to the \u201cHomepage\u201d at registration.<\/p>\n<p>\u2461 If the notifications shall be provided to unspecified number of \u201cMembers\u201d, individual notifications can be replaced with posting on the bulletin board at the \u201cHomepage\u201d for at least one(1) week. However, individual notifications shall still be provided for matters that have a significant impact on the transactions between the \u201cCompany\u201d and the \u201cMembers\u201d.<\/p>\n<h6>Article 7. Protection of Personal Information<\/h6>\n<p>\u2460 The \u201cCompany\u201d shall collect personal information at the \u201cHomepage\u201d to the extent it is necessary for providing the \u201cServices\u201d to the \u201cUsers\u201d. The following items are required, and the other items are optional.<\/p>\n<ol>\n \t<li>Name<\/li>\n \t<li>Phone number (including mobile)<\/li>\n \t<li>User ID (for the \u201cMembers\u201d)<\/li>\n \t<li>Password (for the \u201cMembers\u201d)<\/li>\n \t<li>Email address<\/li>\n<\/ol>\n<p>\u2461 When collecting or using the personal information of the \u201cUsers\u201d, the \u201cCompany\u201d shall notify the purpose to and obtain consents from the \u201cUsers\u201d in advance.<\/p>\n<p>\u2462 The \u201cCompany\u201d shall not use any personal information for any purposes other than notified to and consented by the \u201cUsers\u201d. When a new purpose of use arises or when the personal information is to be provided to a third-party, the \u201cCompany\u201d shall notify the \u201cUsers\u201d and obtain the consent by the \u201cUsers\u201d before taking any action. However, this is not applicable for the following conditions:<\/p>\n<ol>\n \t<li>When it is required for public statistics, academic research, or provided in a form that does not identify a specific individual<\/li>\n \t<li>When it is required for the payment in association with transactions of the \u201cServices\u201d in the \u201cHomepage\u201d<\/li>\n \t<li>When identity verification is required to prevent misuse, abuse or theft of personal information<\/li>\n \t<li>When it is required by the laws and regulations<\/li>\n \t<li>When the relevant laws and regulations specify otherwise<\/li>\n<\/ol>\n<p>\u2463 When the \u201cCompany\u201d uses the personal information of the \u201cUsers\u201d, the \u201cCompany\u201d shall specify or provide information required under the Act on Promotion of Information and Communications Network Utilization and Information Protection, including personal information manager (job title, name, telephone number and contact information), purpose of collection and use, and third-parties using the personal information (recipient, purpose and content), and obtain a prior consent of the \u201cUsers\u201d pursuant to Item 2 and Item 3 above. The \u201cUsers\u201d may withdraw their consent at any time.<\/p>\n<p>\u2464 The \u201cUsers\u201d can request access to their personal information held at the \u201cHomepage\u201d and request for correction of errors at any time. The \u201cCompany\u201d shall take necessary actions to accommodate such request without delay. If the \u201cUsers\u201d request correction of errors, the \u201cCompany\u201d shall not use such personal information until the errors are corrected.<\/p>\n<p>\u2465 In order to protect the personal information, the \u201cCompany\u201d shall limit the number of people who handle the personal information of the \u201cUsers\u201d to a minimum, and shall be liable for the User\u2019s damage caused by willful misconduct or gross negligence by the \u201cCompany\u201d.<\/p>\n<p>\u2466 The \u201cCompany\u201d or any third-party who receives personal information from the \u201cHomepage\u201d shall destroy such personal information immediately when the purpose of collection and use of the personal information is achieved.<\/p>\n<p>\u2467 The \u201cCompany\u201d shall not leave the consent boxes for collecting and using the personal information checked by default. In addition, the \u201cHomepage\u201d shall specify the consequences of not giving the consent, and shall not limit or decline the applications for membership and\/or \u2018Paid Services\u2019 due to not giving the consent on use of the personal information other than required.<\/p>\n<h6>Article 8. Obligations of the Company<\/h6>\n<p>\u2460 The \u201cCompany\u201d shall not perform any act against the laws, these terms of use or public orders, and shall exercise its commercially reasonable efforts to provide reliable \u201cServices\u201d in accordance with these Terms of Use.<\/p>\n<p>\u2461 The \u201cCompany\u201d shall establish a security system to protect the personal information of the \u201cUsers\u201d (including credit card information) so that the \u201cUsers\u201d can use the \u201cServices\u201d safely.<\/p>\n<p>\u2462 The \u201cCompany\u201d shall be responsible for damages to the \u201cUsers\u201d caused by any unfair labeling or unauthorized advertising with regard to the \u201cServices\u201d, as specified in Article 3 of the Act on Fair Labeling and Advertising.<\/p>\n<p>\u2463 The \u201cCompany\u201d shall not send commercial advertising emails to the \u201cUsers\u201d without the \u201cUsers\u201d\u2019 prior consents.<\/p>\n<h6>Article 9. Obligations of the Users<\/h6>\n<p>The \u201cUsers\u201d shall not do the following:<\/p>\n<ol>\n \t<li>Use the personal information of the other \u201cUsers\u201d<\/li>\n \t<li>Change information posted on the \u201cHomepage\u201d without approval of the \u201cCompany\u201d<\/li>\n \t<li>Send or post information (computer programs, etc.) other than approved by the \u201cCompany\u201d<\/li>\n \t<li>Infringe intellectual property rights, such as copyrights of the \u201cCompany\u201d, the \u201cHomepage\u201d and\/or other third-parties, without prior consents by the subject parties<\/li>\n \t<li>Damage the reputation of the \u201cCompany\u201d, the \u201cHomepage\u201d and\/or other third-parties, or interrupt their businesses<\/li>\n \t<li>Post obscene or violent messages, images, sounds, or other information that is contradictory to any public order and\/or conventions<\/li>\n<\/ol>\n<h6>Article 10. Copyright and Restrictions of Use<\/h6>\n<p>\u2460 The copyright and other intellectual property rights for the proprietary work of the \u201cCompany\u201d belong to the \u201cCompany\u201d. However, this shall not be applicable if the \u201cCompany\u201d provides any third-party work to the \u201cUsers\u201d without any revision, amendment or reproduction.<\/p>\n<p>\u2461 The \u201cUsers\u201d shall not, directly or indirectly, transform, copy, distribute, publish, exhibit, sell, broadcast, or allow any third-party to use any information acquired during the use of the \u201cHomepage\u201d, without prior consent of the \u201cCompany\u201d.<\/p>\n<p>\u2462 The \u201cCompany\u201d shall notify the \u201cUser\u201d and obtain a prior consent when the \u201cHomepage\u201d is to use the work whose copyright belongs to the \u201cUser\u201d. However, the notification can be submitted after the fact, if a prior notification is not practically possible.<\/p>\n<h6>Article 11. Indemnification regarding the Services<\/h6>\n<p>\u2460 If the \u201cServices\u201d cannot be provided due to natural disasters, war, or other force majeure events, the liability of the \u201cCompany\u201d for providing the Service shall be waived.<\/p>\n<p>\u2461 The \u201cCompany\u201d shall not be liable for any obstacles or damages in using the \u201cService\u201d due to reasons attributable to the \u201cUsers\u201d.<\/p>\n<p>\u2462 The \u201cCompany\u201d shall not be liable for failures to provide the \u201cServices\u201d if such interruption is caused by telecommunication service providers.<\/p>\n<p>\u2463 The \u201cCompany\u201d shall not be liable for damages caused by unavoidable reasons such as repair, replacement, regular inspection, and construction of service equipment.<\/p>\n<p>\u2464 The \u201cUsers\u201d are responsible for protecting their own mandatory registration items (mobile phone number, email address, etc.) and passwords that they have provided to the \u201cHomepage\u201d to use the \u201cServices\u201d, and the \u201cCompany\u201d shall not be liable for any damage caused by the leakage of such information by the \u201cUser\u201d, whether intended or unintended.<\/p>\n<p>\u2465 The \u201cCompany\u201d shall not be liable for any damages caused by the computer system of the \u201cUser\u201d or the poor management of the personal information by the \u201cUser\u201d.<\/p>\n<p>\u2466 The \u201cCompany\u201d shall not be obligated to intervene in disputes that occur among the \u201cUsers\u201d or between the \u201cUsers\u201d and third-parties in association with the \u201cServices\u201d, and shall not be liable for damages caused in association with such disputes.<\/p>\n<p>\u2467 The \u201cCompany\u201d shall not be responsible for the validity, suitability, legal rationality, copyright compliance, etc. of the contents provided at or linked to the \u201cHomepage\u201d, or included in partner companies (including websites), and shall not be liable for any loss or damage caused by them.<\/p>\n<p>\u2468 The \u201cUsers\u201d shall be liable for any loss or damage that may occur by reproducing the \u201cServices\u201d provided at the \u201cHomepage\u201d, and the \u201cCompany\u201d shall not be liable for such damages. However, the \u201cCompany\u201d shall be liable for such damages if the damages are caused by gross negligence or willful misconduct by the \u201cCompany\u201d.<\/p>\n<h6>Article 12. Dispute Resolutions<\/h6>\n<p>\u2460 The \u201cCompany\u201d shall operate a separate place or section handling the feedback of the \u201cUsers\u201d or complaints at the \u201cHomepage\u201d. However, the \u201cCompany shall notify the \u201cUsers\u201d of expected timeline if such feedback or complaints cannot be processed on time.<\/p>\n<p>\u2461 The request for damage relief by the \u201cUsers\u201d in association with disputes with the \u201cCompany\u201d shall be subject to the arbitration by arbitrators designated by the Fair Trade Commission, the mayor or the governor.<\/p>\n<p>\u2462 When the \u201cServices\u201d at the \u201cHomepage\u201d is reused commercially and\/or distributed to third-parties for profit, the copyright fee shall be charged directly to the \u201cUser\u201d, indirectly through a legal representative, or by way of a litigation pursuant to the copyright laws.<\/p>\n<h6>Article 13. Jurisdiction and Governing Law<\/h6>\n<p>\u2460 The \u201cCompany\u201d and the \u201cUsers\u201d agree upon that Seoul Central District Court is the exclusive jurisdiction for any dispute arising out of or in connection with these terms of use.<\/p>\n<p>\u2461 Any litigation between the \u201cCompany\u201d and the \u201cUsers\u201d in relation to these terms of use shall be governed by the laws of the Republic of Korea.<\/p>\n<h6>Article 14. Effective Date<\/h6>\n<p>These terms of use shall be taken into effect on January 1, 2023.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<\/div><\/fieldset><\/div><div id=\"wpforms-851-field_2-container\" class=\"wpforms-field wpforms-field-checkbox\" data-field-id=\"2\"><fieldset><legend class=\"wpforms-field-label wpforms-label-hide\" aria-hidden=\"false\">Privacy Policy <span class=\"wpforms-required-label\" aria-hidden=\"true\">*<\/span><\/legend><ul id=\"wpforms-851-field_2\" class=\"wpforms-field-required\"><li class=\"choice-1 depth-1\"><input type=\"checkbox\" id=\"wpforms-851-field_2_1\" name=\"wpforms[fields][2][]\" value=\"I agree to the Provacy Policy below.\" aria-errormessage=\"wpforms-851-field_2_1-error\" aria-describedby=\"wpforms-851-field_2-description\" required ><label class=\"wpforms-field-label-inline\" for=\"wpforms-851-field_2_1\">I agree to the Provacy Policy below. <span class=\"wpforms-required-label\">*<\/span><\/label><\/li><\/ul><div id=\"wpforms-851-field_2-description\" class=\"wpforms-field-description wpforms-disclaimer-description\"><h6>Privacy Policy<\/h6>\t\t<div data-elementor-type=\"section\" data-elementor-id=\"997\" class=\"elementor elementor-997 elementor-857 elementor-857\" data-elementor-post-type=\"elementor_library\">\n\t\t\t<div data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-element elementor-element-955c97f e-con-full e-flex e-con e-parent\" data-id=\"955c97f\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-8c0dfd1 elementor-widget elementor-widget-text-editor\" data-id=\"8c0dfd1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Lobin Co. (hereinafter referred to as \u201cCompany\u201d) is bound by the following privacy policy established by the \u201cCompany\u201d to process the personal information, and shall protect the personal information, rights and interests of the Users in accordance with Article 30 of the Personal Information Protection Act.<\/p><h6>Article 1. Purpose of Processing the Personal Information<\/h6><p>\u2460 The \u201cCompany\u201d collects and manages the personal information for the following purposes. The processed personal information shall not be used for purposes other than the following and, in the case of change in such purposes, the \u201cCompany\u201d shall take necessary actions, such as obtaining a separate consent in accordance with Article 18 of the Personal Information Protection Act.<\/p><ol><li>Membership: Confirmation of intention to sign up as a member, verification of qualification for access to membership services, retention and maintenance of membership qualification, compliance with the enforced limited identification, prevention of unauthorized use of services, verification of legal representative for processing of personal information of children under the age of 14, notification of important matters regarding services and management of claims.<\/li><li>Services: Providing services, delivering agreement and invoices, verifying identity, and settling payments.<\/li><li>Supports: Verification of claimant\u2019s identity, confirmation of the claims, communication and notification of verification purposes, and notification of processing status.<\/li><\/ol><h6>Article 2. Processing and Retention Period of the Personal Information<\/h6><p>\u2460 When collecting the personal information from the Users or during the retention period of the personal information in accordance with the Personal Information Protection Act, the \u201cCompany\u201d shall process and retain the personal information within the processing and retention period consented by the users.<\/p><p>\u2461 The processing and retention period of the personal information shall be as follows:<\/p><ol><li>Personal information regarding registration and management of the membership: Until the termination of the membership. Providing the Personal Information to the Third Party<\/h6><p>The \u201cCompany\u201d processes the personal information of the User in accordance with Article 1 hereof, and provides the personal information of the user to a third party only in accordance with Article 17 of the Personal Information Protection Act.<\/p><h6>Article 4.
